Contractual relations are in accordance with Czech law and the terms and conditions shall be governed by Civil Code (No. 40/1964 Coll.) and the Consumer Protection Act (No. 634/1992 Coll.).
The purchase contract is entered into by the placing of an order by the buyer and by a written confirmation of the order by the seller. This confirmation is to be sent by the seller to the buyer immediately by email to the email address specified by the buyer. The resulting contract (including the agreed upon price) can be changed or cancelled only upon agreement of both parties or on the basis of legal grounds.
By entering into a purchase contract the buyer confirms that he is familiar with these terms and conditions, including all claim conditions, and that he agrees to them. These terms and conditions and claims procedure are adequately presented to the buyer before placing the order and he has the opportunity to become acquainted with them.
The period for claims processing is suspended if the seller has not received all the documents required for processing the claim (product parts, other documents, etc.). The seller is obliged to request necessary additional documentation from the buyer in the shortest possible time. The claims period is suspended from that date until the delivery of the documents requested by the buyer.
Seller reserves the right to cancel the order or part thereof before a purchase contract is concluded on the basis of agreement with the buyers in these events: the goods are not produced or delivered or the price has significantly changed at the supplier. In the event that the buyer paid part or full purchase price, this amount will be transferred back to his own account or address, and the purchase contract will be voided.
The consumer cannot exercise any rights concerning gifts, which are freely given without charge. Such goods fall under the conditions of Donation agreements and any applicable rules in accordance with legislation of the CR.
Delivery Conditions
Buyer selects means of transport in the order form:
• shipping company or seller's own transportation
• personal collection (available only at the headquarters of the seller)
The price of transport throughout the EU outside the Czech and Slovak Republic is:
50, - EUR incl VAT for delivery of bedframes and mattresses for all sizes.
Delivery times
Normal delivery times are 2-3 weeks from the date of receipt and confirmation of the order. Goods that are currently in stock (always marked in the product description), are delivered by the seller within 5 working days.
Payment Terms
Method of payment is selected by the buyer in the order form.
• Bank Transfer - advance payment. After sending the order form the seller sends an invoice to the customer's e-mail. After payment the buyer will be informed about receipt of funds in the seller's account. Delivery times of goods are counted from the day the funds appear in the seller's account.
• In cash - this method of payment can be made only at the headquarters of the seller with personal pick up of goods.
Conflict with the contract
In the case that the item when received by the buyer is not in conformity with the contract (hereinafter referred to as "conflict with the contract"), the buyer has the right to demand that the seller provides the product in a manner corresponding to the purchase contract and that he does so free of charge and without undue delay, either by replacement or repair according to the buyers choice, in the event that such procedure is impossible, the buyer may request a reasonable price discount or withdraw from the contract. This does not apply in cases where the buyer knew about the conflict with the contract or personally caused the conflict with the contract. Conflict with the purchase contract, which is discovered within a six month period after receipt of goods, is considered as a contradiction existing upon receipt of said goods, if this does not go against the nature of the goods or is proven otherwise.
Withdrawal from the contract
If the purchase contract is concluded by means of distance communication (the Internet), the consumer in accordance with § 53 paragraph 7 of the Civil Code has the right to withdraw from the contract within 14 days of receipt of goods. This provision is not to be understood as an opportunity to borrow free goods.
In the event of returning goods, the buyer is to contact the seller in writing stating intent to withdraw from the contract and provide order number, purchase date and account number for refund. Withdrawal from the contract must be delivered no later than the last day of the 14 day period. Returned goods must be unused, intact and complete (including all accessories, instructions, warranty card, etc.)
When all these conditions for returning goods are met, the money will be sent by postal order or transfer of funds to bank account no later than within 14 working days from receipt of goods. Money can also be returned in cash at the company office. In case of failure to deliver complete goods or other circumstances contrary to the above mentioned conditions, the time period for refund is postponed until the full delivery of complete goods.
All costs associated with transportation of goods, are to be paid by the buyer.
The right to withdraw from the contract does not apply with the delivery of custom produced goods (not in the standard offer, this primarily refers to goods of custom produced dimensions).
Privacy Policy
Customer information is stored in accordance with valid laws of the Czech Republic, specifically the Law on Personal Data Protection No. 101/2000 Coll. and subsequent amendments and regulations. Buyer agrees by entering into the contract to the processing and collection of their personal data in the seller's database after successful completion of the contract, and until a written statement disagreeing with such processing.
The buyer has the right to access personal data, the right to correct discrepancies, including other legal rights to such data. Personal data of customers can be removed from the database on the basis of a written request. Personal data of customers is fully protected against abuse. Personal data of customers is not provided to any other persons. An exception is to external carriers to whom the personal data is provided to the minimal extent as required for delivery of goods.
Individual contracts are archived after conclusion in electronic form and are accessible only to trade operators.
Final Provisions
These terms and conditions as stated on the web site of the seller apply the day the purchase contract is entered into. Customer order is archived after its confirmation as a concluded contract between the buyer and seller to fulfill its purpose and for other records, and its status is available to the buyer. Contracts may be concluded in Czech, German, and English. By purchasing, customer agrees to receive commercial communication.
The customer is entitled to the storage and reproduction of these terms and conditions. At the moment of entering into the purchase contract, the buyer accepts all provisions and conditions valid at the date of dispatch of order including the price of goods specified in the confirmed order, unless clearly stated otherwise in a particular case.
